Industrial Code Rule 59

What the notice means for you

Code Rule 59 is New York State's workplace safety and loss prevention program. If your workers' compensation claims have pushed your experience modification rate too high, the state requires a safety consultation by a certified consultant, and the clock starts the day the notice arrives.

If the consultation isn't completed, your insurance carrier is required to add a 5% penalty at renewal, and it grows by 5% every year you are out of compliance.

It sounds like trouble, but it's fixable. A good consultation fixes the gaps in your safety program, and a safer workplace is how your experience modification rate (EMR) and your insurance costs come back down.
